This Policy, together with our Participation Agreement and if applicable, our Business Associate Agreement, as well as our Terms and Conditions of Use sets out the basis on which any personal data we collect from You, or that You provide to us, will be processed by us. By using our website (“Site”), You are accepting the practices described in this Privacy Policy and Notices of Privacy Practices (“Privacy Policy”).

By using this Site, You consent to the use of information that You provide us in accordance with this Privacy Policy. We do update this Privacy Policy from time to time so please review this Privacy Policy regularly. If we materially alter our Privacy Policy, we will notify You of such changes by contacting You through Your user account e-mail address or by posting a notice on our Site. Your continued use of the Site will be deemed Your agreement that Your information may be used in accordance with the new policy. If You do not agree with the changes, then You should stop using the Site and You should notify us that You do not want Your information used in accordance with the changes.

Authorization to Access, Use and Disclose Your Personal Information & Protected Health Information

You understand and agree that we will disclose the information you provide to us through the Site and EMR to third parties, including, but not limited to, healthcare organizations and your healthcare providers in order to provide assistance to you and your health care providers. You hereby warrant that you consent and authorize such disclosure of any and all of your personal information and protected health information, including, to the extent such information exists, HIV/AIDS infection information, genetic information, sexually transmitted disease information, mental/behavioral health, and/or substance abuse treatment information.

You understand that your health information is protected under federal privacy laws and regulations and under state law, and cannot be disclosed without your consent except as otherwise specifically provided by law.

Your consent will expire upon your termination of your CMT EMR account. You may revoke your consent at any time by notifying CMT. However, any previously disclosed information would not be subject to your revocation request because once the health information is released by CMT it may be re-released by the recipient of the information and no longer protected by federal law.

In order to participate in the EMR, you must agree to the terms and conditions contained in this Privacy Policy, which is a legal agreement to which you are contractually bound. By clicking the box, you are certifying that you are signing on behalf of yourself, that you have the legal authority to do so, and that you are contractually bound by the terms and conditions above. Your agreement with CMT shall become effective when you click the box and shall continue thereafter until terminated by either you or CMT.
